1. About these terms

These Terms of Use (“Terms”) govern your use of the website at tortugatech.co (“the site”). By using the site, you agree to these Terms. If you do not agree, please leave the site.

These Terms cover the website only. Each Tortuga Tech product (currently the Datey iOS app) has its own End User License Agreement that governs your use of that product — see, for example, Datey’s EULA.

2. Who we are

The site is operated by Tortuga Global Tech LLC, a Wyoming limited liability company.

References in these Terms to “we,” “us,” “our,” “Tortuga,” and “the studio” mean Tortuga Global Tech LLC.

3. What the site is

The site is an informational marketing presence. It describes the studio, the apps we are building, and the legal terms under which our apps are distributed. The site does not offer downloadable software directly; our apps are distributed through the Apple App Store under their own licences.

4. Permitted use

You may:

• Read the site and share links to it with anyone.
• Quote brief excerpts in articles, posts, or reviews with attribution.

You may not:

• Scrape, mirror, or systematically reproduce the site without our written permission, except for routine indexing by reputable search engines.
• Misrepresent yourself as Tortuga Global Tech LLC or any of its representatives.
• Use the site, or content from it, to harass, defraud, or mislead any person.
• Attempt to disrupt the site’s operation, probe it for vulnerabilities without permission, or interfere with its security mechanisms.

If you believe you have found a security issue, please contact support@tortugatech.co and we will respond.

5. Intellectual property

All content on the site — including text, branding, logos, mascots, illustrations, and source code — is owned by Tortuga Global Tech LLC or its licensors and is protected by United States and international intellectual-property laws. You receive no licence to use any of this content other than to view and link to the site.

The Tortuga turtle logo and the Datey mascot are trademarks of Tortuga Global Tech LLC.

6. External links

The site may link to third-party sites (such as Apple, Cloudflare, RevenueCat, the UK Information Commissioner’s Office, and others). We are not responsible for the content or practices of those sites; visiting them is at your own risk and subject to their own terms.

7. Disclaimer of warranties

The site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of liability

To the maximum extent permitted by applicable law, Tortuga Global Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the site. Our total aggregate liability arising out of these Terms or the site will not exceed US $50.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — including, in the United Kingdom and the European Union, liability for breach of statutory rights under the UK Consumer Rights Act 2015 or the EU consumer-protection framework; in any jurisdiction, liability for fraud, gross negligence, or death or personal injury caused by our negligence. For consumers resident in the United Kingdom or the European Union, to the extent that the cap above conflicts with your mandatory statutory rights, the cap does not apply and our liability is instead limited to losses that we could reasonably have foreseen at the time you accepted these Terms.

9. Privacy

Your privacy on the site is described in our Privacy Policy. In short: we host the site on Cloudflare; Cloudflare keeps anonymous request logs for up to 30 days; we run no cookies, analytics, or trackers ourselves.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be summarised in a banner on the home page for at least 14 days. The “Last updated” date at the top of this page will always reflect the current version.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the site or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Laramie County, Wyoming.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose consumer-protection laws grant you mandatory rights that override this choice of law or forum, those mandatory rights are not displaced.

12. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tortuga Global Tech LLC concerning the site.
